1. Introduction

Welcome to Top Gear Tuning West Midlands (“we”, “us”, “our”). By accessing or using our website www.topgeartuningwestmids.co.uk, purchasing our products or booking our services, you agree to comply with and be bound by these Terms of Business. If you do not agree, please do not use our website or services.

We operate as an authorised Powerflow Exhausts dealer and ECU remapping specialist for both performance and economy tuning.

3. Services & Bookings

  • All bookings require a non-refundable deposit (usually £50) to secure your appointment slot.

  • Remaining balances must be paid in full on the day of your appointment before the vehicle is released.

  • Any missed or cancelled appointments within 24 hours of the booking may forfeit the deposit.

  • Quotes are valid for 30 days from the date issued.

4. Vehicle Condition & Customer Responsibility

You must ensure that your vehicle is roadworthy, mechanically sound, and suitable for the requested work. We reserve the right to refuse work on vehicles that present safety concerns or are in poor condition.

We accept no liability for pre-existing faults or subsequent issues unrelated to the specific work carried out.

5. Remapping & Performance Modifications

Remapping or modification services may alter manufacturer settings. It is the customer’s responsibility to check how modifications could affect:

  • Manufacturer or dealer warranties

  • Insurance policies

  • Emissions or MOT compliance

All tuning work is carried out at the customer’s own risk. While we take every reasonable step to ensure safety and reliability, Top Gear Tuning West Midlands is not liable for engine, transmission, or component failure resulting from remapping, poor maintenance, or excessive stress placed on the vehicle.

5.1. ECU REMAPPING TERMS AND CONDITIONS

1. Customer Responsibility

It is the customer’s responsibility to ensure that their vehicle is in good mechanical condition and suitable for tuning before any remapping work begins. This includes (but is not limited to):

  • Ensuring the engine, turbocharger/supercharger, fuel system, ignition system, clutch, gearbox, cooling system, and exhaust are all in proper working order.

  • Ensuring that there are no warning lights, fault codes, or pre-existing mechanical/electrical issues prior to the remap.

  • Informing us of any known faults, modifications, or previous tuning work carried out on the vehicle.

Top Gear Tuning West Midlands reserves the right to refuse or postpone remapping work if we believe the vehicle’s condition could cause damage or make tuning unsafe.

2. Pre-Tune Health Checks

We carry out basic diagnostic checks prior to remapping. These checks are designed to identify obvious faults but do not guarantee the overall mechanical health of the vehicle. It is recommended that customers perform a full service and inspection before booking any remapping work.

We accept no liability for undetected or developing faults that may become apparent after tuning.

3. Post-Remap Performance and Reliability

Remapping alters factory engine parameters, including fuel delivery, boost pressure, and ignition timing. While every effort is made to ensure reliability and drivability, it is important to understand that:

  • Increased performance may accelerate wear on certain components such as clutches, turbos, gearboxes, driveshafts, and cooling systems.

  • Components already worn or nearing failure may fail shortly after a remap due to increased load.

  • Top Gear Tuning West Midlands cannot be held liable for any post-remap mechanical, electrical, or component failures unless directly caused by proven workmanship error.

4. Manufacturer Warranties & Insurance

Customers are advised that remapping may void or affect:

  • Manufacturer and extended warranties

  • Breakdown cover terms

  • Insurance coverage

It is the customer’s responsibility to notify their insurer or warranty provider of any modifications made.

5. Road Legality and Emissions

All remaps are intended for road-legal use unless specifically stated otherwise. Any removal or deletion of emissions systems such as DPF, EGR, or AdBlue must comply with UK Road Traffic Acts and MOT regulations.
Top Gear Tuning West Midlands accepts no liability for the use of vehicles modified for off-road or motorsport purposes on public highways.

6. Aftercare and Software Support

  • We provide a 12-month remap software guarantee, which includes free reinstallation if the ECU is reset or overwritten by a dealership update.

  • The guarantee does not cover issues caused by tampering, mechanical faults, or external modification post-remap.

  • Customers should return within 14 days if they experience drivability concerns for a complimentary health check.

7. Limitation of Liability

To the fullest extent permitted by law, Top Gear Tuning West Midlands shall not be liable for:

  • Engine, drivetrain, or component failure following remapping

  • Loss of vehicle use, data, or income

  • Any indirect or consequential damages

Our liability is limited strictly to the value of the service provided.

6. Prices & Payments

All prices include VAT unless otherwise stated. We accept card, cash, and electronic payments. Outstanding balances must be cleared before the vehicle leaves our premises.

7. Warranty & Aftercare

Workmanship and exhaust systems are covered under our Warranty Policy, outlined on the Warranty page. Remaps carry a 12-month software guarantee, covering reinstallation in case of accidental dealer overwrite or battery disconnection.

8. Intellectual Property

All content, graphics, and materials on this website are owned by or licensed to us. Unauthorised use, reproduction or redistribution of any content is prohibited.

9. Limitation of Liability

To the fullest extent permitted by law, we exclude liability for:

  • Any indirect or consequential loss or damage

  • Loss of profit, income, or data

  • Issues arising from misuse, modification, or neglect of your vehicle

Your statutory rights are not affected.

WARRANTY POLICY

1. Powerflow Exhaust Guarantee

Your Powerflow stainless steel exhaust system is covered by a lifetime guarantee for as long as you remain the registered keeper of the vehicle, subject to the following conditions.

Coverage

  • Manufacturing or workmanship defects

  • Weld or fabrication failure

  • Free repair or replacement (at our discretion)

Exclusions

  • Catalytic converters, DPFs, manifolds, flexi joints, and rubber mounts (12 months)

  • Surface discolouration, corrosion, or impact damage

  • Damage from racing, competition, or track use

  • Systems modified or repaired by third parties

Claim Procedure

  • Warranty claims must be made by appointment at the original installation depot

  • You must provide the original invoice and vehicle registration document

  • If necessary, warranty work may be referred to Powerflow HQ in Bridport

2. ECU Remap Software Guarantee

We offer a 12-month remap guarantee covering:

  • Free reinstallation if the ECU is reset or overwritten by a dealer

  • Free health check within 30 days of installation

This guarantee excludes damage caused by:

  • Mechanical failure unrelated to the remap

  • Poor maintenance or aftermarket modifications

  • Use in motorsport or competition

3. General Limitations

These warranties do not cover consequential loss or third-party costs. Your statutory rights are not affected.
